What are my rights if I buy a car from a dealer?
When you buy a car from a car dealer, you have rights under the Consumer Guarantees Act and the Fair Trading Act . You also have rights under the Motor Vehicle Sales Act. Basically the car has to match its description and be of acceptable quality. If it isn’t and/or something goes wrong, then depending on the nature of the problem the dealer has to repair, refund or replace the car. If you have any problems with a car dealer you can make a claim to the Disputes Tribunal or the Motor Vehicle Disputes Tribunal (MVDT). The MVDT can hear claims of up to $50,000 (or more if both parties agree) while the Disputes Tribunal can only hear claims of up to $15,000 (or up to $20,000 if both parties agree). There are time limits for going to the MVDT so make sure you act as soon as possible. To contact the MVDT call 0800 367 6838.
What are my rights when buying goods from a pawn shop?
Pawn shops are like any other retailer so you will be covered by the Consumer Guarantees Act and Fair Trading Act. Remember that the Act will look at what a ‘reasonable’ person would think of as acceptable, taking in all factors like price, information about the goods, and wear and tear, so make sure you shop around and know what you are buying before you decide. If you need more information you can contact your local Citizens Advice Bureau.
