I had a heatpump installed three years ago. It has never heated my room properly, and has caused dark staining on the walls and ceiling. It has a five-year warranty. Neither the manufacturer nor the retailer will take responsibility for fixing it.
What happens next will depend on the circumstances under which you bought the heatpump. On the one hand, if the retailer advised you of the model to buy and it turned out that the heatpump wasn’t ‘fit for purpose’ then you will be covered by the Consumer Guarantees Act for both the heatpump and any damage that it caused to your wall. If on the other hand you decided which model to buy on your own, and you chose the wrong one, then you might not be covered by the Consumer Guarantees Act. If you aren’t sure or need more information, contact your local Citizens Advice Bureau about your situation.
I bought a toaster that was faulty and caused damage to my kitchen wall. What can I do?
This damage is called consequential loss – that means that you have suffered a loss that is caused because something was wrong with the goods or a service you received. Under the Consumer Guarantees Act , you can claim the costs of repairing the kitchen wall from the trader. You do have a responsibility to minimise damage once you are aware of what is happening. A trader’s responsibility is not unlimited and can only be for foreseeable loss. For more information about consequential loss visit this website .
